Terms of Service

Welcome to Packette. These Terms are an agreement between you and Alana Sivo (“Packette,” “we,” “us”). By creating an account or using the Packette app or the packette.app website (together, the “Service”), you agree to them. If you don't agree, please don't use the Service.

1. Packette is a beta

Packette is currently distributed as a free beta through Apple TestFlight. That means:

  • Features may change, break, or be removed without notice.
  • Data loss, bugs, and downtime are possible. Please don't rely on Packette as the only copy of a photo you care about.
  • TestFlight builds expire after a period set by Apple, and you may need to install updates to keep using the app.
  • We may end the beta, change how Packette is distributed, or begin charging for some features in the future. If we introduce paid features, we'll make that clear before you're charged.

2. Who can use Packette

You must be at least 13 years old (16 in the European Economic Area and the UK) to use Packette. If you're under 18, you should have a parent or guardian's permission. By using the Service, you confirm you meet these requirements.

3. Your account

You're responsible for your account and for keeping your password secure. Please give us an email address you actually control — we use it for account recovery and important notices. Tell us at support@packette.app if you believe someone else is using your account.

4. Your content

You own what you post. Your photos, captions, comments, and other content remain yours.

To run the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, resize, and display your content — solely for the purpose of operating Packette and showing your content to the members of the trips you post it in. This license ends when you delete the content or your account, except for content others have already saved to their own devices and copies that remain briefly in routine backups.

We will not use your content for advertising, sell it, publish it publicly, or use it to train AI models.

You are responsible for what you post. By posting, you confirm that:

  • You have the right to share it.
  • If other people appear in a photo, you have their permission to share it with your trip.
  • It doesn't infringe anyone's rights or break the law.

Remember that anything you post is visible to everyone in that trip, and they can screenshot or save it. Post accordingly.

5. Rules of use

Don't use Packette to:

  • Post content that is unlawful, harassing, hateful, threatening, sexually explicit, or that exploits or endangers a minor.
  • Post someone else's photos or personal information without their permission.
  • Impersonate anyone, or misrepresent who you are.
  • Attempt to access trips, accounts, or data you weren't invited to, or probe, scan, or interfere with the Service's security.
  • Scrape, bulk-download, reverse engineer, or build a competing product from the Service.
  • Use the Service to send spam or automated requests.

We may remove content or suspend or terminate accounts that violate these Terms, or where we reasonably believe it's necessary to protect users or the Service.

6. Trips and invites

Trips are private and invite-only. Anyone with a trip's invite code can join that trip, so share codes only with people you want in it. Trip owners can remove members and delete trips; members can leave at any time. Deleting a trip removes its content for everyone in it.

7. Ending your use

You can stop using Packette at any time and delete your account from Profile → Settings → Delete account. Deletion is permanent. We may suspend or terminate your access if you violate these Terms, or if we discontinue the Service.

8. Our intellectual property

The Packette name, logo, design, and software are owned by Alana Sivo. These Terms don't give you any right to use them beyond using the app as intended.

9. Third-party services

Packette links to and relies on third-party services, including Apple TestFlight and, if you add a playlist link, Spotify. We don't control those services and aren't responsible for them; your use of them is governed by their own terms.

10. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that content will not be lost.

11. Limitation of liability

To the fullest extent permitted by law, Alana Sivo will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, content, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim, or US $50.

Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.

12. Indemnity

You agree to indemnify and hold harmless Alana Sivo from claims, damages, and expenses (including reasonable legal fees) arising out of your content, your use of the Service, or your violation of these Terms or of anyone's rights.

13. Changes to these Terms

We may update these Terms as Packette evolves. We'll update the “Last updated” date and, for significant changes, notify you in the app or by email. Continuing to use Packette after changes take effect means you accept them.

14. Governing law

These Terms are governed by the laws of the State of Illinois, United States, without regard to conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Illinois, and you and we consent to that jurisdiction — except that either of us may seek relief in small claims court where eligible.

15. Apple

Packette is distributed through Apple TestFlight. Apple is not a party to these Terms and has no obligation to provide support for the Service. If Packette fails to conform to any applicable warranty, you may notify Apple, and Apple may refund any purchase price (there is none during the beta); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to Packette.

16. Miscellaneous

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision isn't a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service.
